Sales Agreement

The following constitutes a sales agreement between Janell McMorran, (hereinafter referred to as breeder) and __________________________________ (Buyer's Name) (hereinafter referred to as buyer) regarding rats purchased and listed on this document (hereinafter referred to as rat). These terms and conditions are entered into and agreed upon by both buyer and breeder and they acknowledge the moral and legal worth of this contract.

Therefore, it is agreed upon that:
1. This rat is sold first and foremost as a companion animal and family member and is to be cared for as such. The rat is to be cared for in a humane and responsible manner and must be provided adequate mental and physical stimulation as well as any special needs developed by the individual.

2. Breeding of rat(s) #_________ is not permissible. PET ONLY CONTRACT ___________.
A "pet only" contract is defined as an agreement between buyer and breeder that breeding above mentioned rat(s) is forbidden without prior written or verbal consent from FLY. This may be due to health or genetic reasons, some of which may be hereditary; and any desire of the buyer to breed (now or in the future) must be disclosed prior to signing contract. Breeder may halt or delay the transaction at her discretion based on disclosure (or lackthereof) of this information.

Breeding of rat(s) #_________ is permissible. BREEDER CONTRACT ___________.
A "breeder" contract is defined as an agreement between buyer and breeder that breeding above mentioned rat(s) is allowed, with stipulations, without prior written or verbal consent from FLY. Stipulations must be met: This animal's offspring and their future offspring for up to three (3) generations may not be knowingly sold, traded, adopted to or given to a non-approved breeder. Approved breeders currently include herself (FLY); ARS in New York, AMOR in California, ARAZ in Arizona, CPA in California, DBR in California, DRBR in California, FAR in California, FFCR in California, MARS in Arizona, RRR in California, CHRM in Texas. Buyer may inquire about any other breeder for details or approval. FLY may, can and likely will refuse future adoptions to this buyer if her stipulations are not met.

3. In the event that the buyer wishes to enter this rat in a show, buyer agrees to use the prefix FLY in the formal naming of this rat. The Breeder/buyer agrees to use FLY in the formal naming of this rat on websites and all other official documentation where rats name is stated, i.e. contracts and pedigrees.

4. The buyer is expected to keep the rat in a safe and comfortable environment at all times, ensuring the rat always has food and water provided for it, and avoiding temperature extremes or placing the rat in a situation where another animal could cause harm to it. The buyer is expected to supervise small children around the rat.

5. The buyer is also expected to attend to the health needs of the rat, including keeping it in a sanitary environment and providing proper medical treatment should it be necessary.

6. If for any reason during the life of this rat the buyer decides he/she does not want the rat, the buyer will advise and consult with the breeder regarding placement of the rat. At no time will the buyer sell or give the rat to any pet store, breeding farm, or similar organization engaged in the utilization of rats as food for other animals or sale for commercial profit, nor to any individual or entity engaged in research. For no reason should this rat be placed in any shelter, humane society, or with a similar organization, nor shall the rat be placed with any individual without the specified consent of the breeder and at no time will the buyer set the rat loose to fend for himself.

HEALTH GUARANTEE: To the best of the breeder’s knowledge, this rat is free of any illness or contagious disease. The buyer is responsible for quarantine of the rat for two weeks after taking possession of it. If the rat develops any illness or contagious disease within those two weeks, the buyer has the privilege of returning the rat to the breeder for a refund within that time period. Any illness that occurs after that time period is the responsibility of the buyer.
No other warranties, expressed or implied, are made under this contract, as stated herein.
